Terms of Service
The agreement between you and velixir Ltd when you use the velixir platform.

1. Who these terms are between
These Terms of Service (the “Terms”) are a contract between you (the person or organisation creating an account, the “Customer”) and velixir Ltd (“velixir”, “we”, “us”), a company registered in England & Wales (company no. 17240244) with its registered office at Office 2, Risebridge Farm, Peasley Lane, Cranbrook, England, TN17 1HP. By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
2. The Service
velixir provides a Platform-as-a-Service (the “Service”) that builds, deploys and runs .NET applications on managed Kubernetes infrastructure, with regions available in the European Union, the United Kingdom, the United States and the Asia-Pacific region, alongside managed PostgreSQL and managed Valkey offerings. You choose which region(s) your workloads run in at deployment time. The exact features are described at velixir.net/products and may be updated over time.
3. Account creation
You must provide accurate sign-up information, keep your password confidential, and not share account credentials. You're responsible for all activity on your account. Notify us promptly at [email protected] if you believe your account has been compromised. We may require email verification, two-factor authentication, or hCaptcha challenges as a condition of access.
4. Acceptable use
Your use of the Service is also governed by our Acceptable Use Policy. In short: no crypto mining, no illegal content, no spam, no malware, no targeting our infrastructure, no abuse of the trial credit. Violating the AUP can result in immediate suspension.
5. Subscription, billing and trial credit
- Hourly metering. Compute (apps), databases and caches are billed in hourly increments at the plan rate published at velixir.net/products at the time you provision them.
- Pre-paid balance. The Service runs on a pre-paid balance you top up via Stripe. We deduct from your balance hourly as resources run.
- Auto-topup. You may opt in to automatic top-ups when your balance falls below a threshold. You authorise us to charge your saved payment method to the configured amount.
- Trial credit. New accounts receive up to €14.99 of trial credit, valid for 30 days from sign-up. Trial credit isn't redeemable for cash, isn't transferable, and is non-refundable when used.
- Negative balance. If your balance reaches zero and an auto-topup isn't enabled or fails, your apps are suspended. Suspended apps are kept for 30 days, then permanently deleted.
- Taxes. Prices exclude applicable taxes. Where required, VAT is added at checkout and itemised on your receipt via Stripe Tax.
- Refunds. Pre-paid balance not yet consumed can be refunded on request, minus a reasonable processing fee. Used compute time is non-refundable.
6. Customer data and content
You own your code, environment variables, database contents, cache contents, logs, and any other data you store on the Service (collectively, “Customer Data”). You grant velixir a non-exclusive, worldwide licence to host, process, transmit, copy, back up and display Customer Data as necessary to provide the Service.
Where you process personal data through the Service on behalf of others, our Data Processing Agreement applies as a binding addendum to these Terms - see GDPR Article 28.
7. Customer responsibilities
- You're responsible for the security of the application code you deploy and any vulnerabilities in it.
- You're responsible for backups beyond the platform defaults if your application's requirements warrant them.
- You're responsible for compliance with any laws applicable to your application (data protection, accessibility, financial services regulation, etc.).
- You must not use the Service to compete with velixir or to build a competing hosting platform using our infrastructure.
8. Intellectual property
velixir retains all rights to the Service, the platform software, the documentation, and our trademarks. You retain all rights to your Customer Data. Nothing in these Terms transfers IP ownership in either direction.
9. Service availability
We aim for high availability but don't guarantee a contractual SLA at general-availability launch. The Service is provided on an “as available” basis. Planned maintenance windows are announced via the status page where reasonable; emergency security maintenance may happen without notice. If we introduce a formal SLA for specific plans, it will be published at velixir.net/products and form part of these Terms for those plans.
10. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, velixir disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data loss won't occur. You're strongly encouraged to maintain your own backups and disaster-recovery procedures.
11. Limitation of liability
To the maximum extent permitted by law:
- Neither party is liable for indirect, incidental, consequential, special or exemplary damages, including lost profits or lost data.
- velixir's total aggregate liability arising out of or in connection with these Terms is capped at the greater of (a) the total fees paid by you to velixir in the 12 months immediately preceding the event giving rise to the claim, or (b) £100.
- Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
12. Indemnity
You agree to indemnify velixir against any third-party claim arising from your Customer Data, your use of the Service in breach of these Terms or the AUP, or from your violation of any law.
13. Suspension and termination
- You may close your account at any time from the dashboard. Pre-paid balance is refundable on request (see clause 5).
- We may suspend your account immediately for AUP violations, security incidents, payment failures, or violations of law.
- We may terminate your account on 30 days' notice if you breach these Terms and don't cure the breach within 14 days of notice; or immediately for repeated or serious breaches.
- On termination, you have 30 days to export Customer Data before we permanently delete it.
14. Changes to these Terms
We may update these Terms. The “Last updated” date tracks revisions. We'll notify you by email of material changes at least 14 days before they take effect; using the Service after the effective date constitutes acceptance. If you don't accept a change, you may close your account.
15. Confidentiality
Each party agrees to keep confidential any non-public information shared by the other party. This obligation survives termination and applies indefinitely to trade secrets, and for three years to other confidential information.
16. Governing law
These Terms are governed by the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
